Twelve-Year-Old Brooke Bennett's Body Found

Brook Bennett, age 12, was going to meet a friend at a Randolph, Vermont,. convenience store, and then visit a sick relative at the hospital on June 26, 2008. But, that was a lie. She went missing soon after.

Police are investigating whether her My Space account had anything to do with her disappearance.

A 14 year old witness, and victim, said that Brooke spent time with her uncle, Michael Jacques, a convicted sex offender, later that afternoon, in Randolph.

The witness said she was in the car when Bennett was dropped off at the convenience store. Jacques said he was going to come back for Brooke later. She said Bennett was told she would be going to "party" later.

Surveillance video shows Jacques and Bennett leaving in separate directions.

In an affidavit the 14-year-old told authorities that she helped Jacques take Bennett to Jacques' home, to be initiated into a Breckenridge sex ring.

The girl said she and the 12-year-old watched television for a while before Jacques told her to leave and took the girl upstairs. The witness said she left the house with a boyfriend and did not see the girl again.

The young witness said she herself had been sexually assaulted by Jacques, 42, since she was 9.

She told officials that she knew, as part of the initiation, that Bennett would be having sex with adult males.

She went on to say that she had met three men in the sex ring, and that two other girls were also in the "program."

According to the affidavit, the 14-year-old said, "The first who does it lives and the second gets her throat cut."

Brooke's former stepfather, Ray Gagnon was arrested earlier in the week and charged with obstructing justice for destroying evidence. That information was not discussed by authorities.

Gagnon is being held in Springfield for lack of bail.

Gagnon had been scheduled to be arraigned, July 2nd, on a sexual assault charge involving another minor but the arraignment was canceled as federal authorities took over. At an afternoon news conference, state police head Col. James Baker said that case was still being investigated and the charge could be refiled.

Gagnon was married to Brooke's mother for about five years. Brooke lived with them in Alabama.  Cassandra Gagnon, told the San Antonio Express-News that Gagnon came to Vermont to try to lend a hand after her disappearance made national news last week.

Jacques has convictions, from 1993, for kidnapping and aggravated sexual assault. Prosecutors argued against bail, saying he posed a threat to the accuser and had violated probation.

The authorities searched as the world prayed for Brooke Bennett's safe return.

 A body of a young girl was found on July 1, 2008. On July 2, after further investigation authorities identified the body as Brooke Bennett's. She was found in Randolph, near where her uncle lives.

The family and the public were then notified.

Last week on our Podcast we talked about child sex offenders, and what I think should happen to them.

In Massachusetts, Representative, James Fagan, ranted about what he would do, as a defense attorney, to get his accused sex offender the least time possible if he's convicted. He said he would rip the child apart on the witness stand. He said, "I'm going to make sure that the rest of their life is ruined, that when they’re 8 years old, they throw up; when they’re 12 years old, they won’t sleep; when they’re 19 years old, they’ll have nightmares and they’ll never have a relationship with anybody.” (See the 'In The News' section for the story and video and Podcast for June 29).

Fagan thinks that Jessica's Law, securing a mandatory sentence of 20 years for sex offenders, is way to long.

Some states are upset that they can't put their sex offenders to death.

I think that most of these perverts need to be put away for life. The laws barring them from being around children, and registering as sex offenders, is just not working in so many cases. This story is a great example of why I feel that way.

This little girl should be alive. Is our justice system to blame for her death???  IMO (NLH)

Feds Want Death Penalty

Federal prosecutors said Tuesday they will seek the death penalty in the case of Michael Jacques, the Randolph man charged with kidnapping, drugging, raping and killing his 12-year-old niece Brooke Bennett last summer.

The decision, disclosed in a “Notice of Intent to Seek a Sentence of Death” filed at federal court in Burlington, comes 13 months after Brooke’s disappearance and death gripped the attention of Vermonters and led to reform of the state’s sex offender laws.

Jacques is accused of plotting Brooke’s death for a month, persuading another girl who he had repeatedly molested to help him lure Brooke to his home and then concocting an elaborate scheme to make it look like Brooke had run away to meet someone.

Her disappearance June 25, 2008, triggered a massive search by police and federal agents. Her body was found a week later covered over with dirt in the woods a mile from Jacques’ home.

“Jacques committed the offense ... in an especially heinous, cruel and depraved manner, in that it involved torture or serious physical abuse to the victim,” federal prosecutors wrote in the notice filed with the court.

According to a statement released by the U.S. Attorney’s Office in Burlington, the decision to seek the death penalty was made by Attorney General Eric Holder on Aug. 14.

Tristram Coffin was sworn in as the new U.S. attorney in Vermont one day earlier and said in an interview Aug. 14 he was undecided on whether to urge Holder to have his office pursue a death penalty sentence in the case.

Coffin declined Tuesday to say whether he had offered Holder any thoughts on the decision. Holder already had on hand a recommendation on the death penalty question from Coffin’s predecessor, Thomas Anderson.

Members of Brooke’s family said they were informed of Holder’s decision in a meeting at Coffin’s office Tuesday morning.

“I don’t feel free to comment,” said Cassandra Adams, Brooke’s mother. “It’s a lot to take in right now.” Efforts to reach Brooke’s father, James Bennett, were unsuccessful.

Lawyers for Jacques, who has been in federal custody since his arrest last year, said they were disappointed in the decision by prosecutors to seek the death penalty. Jacques is being held pending trial at a federal penitentiary in Ayer, Mass.

“We had hoped to resolve the case without a trial, but today’s announcement makes that impossible,” David Ruhnke, a Montclair, N.J., attorney who specializes in defending clients in death-penalty cases, said in a statement.

Defense Attorney's seeking more time in death penalty decision

According to a Times Argus article, Jacques defense attorneys are seeking additional time to prepare a death penalty defense for the Randolph man accused of killing 12-year-old Brooke Bennett earlier this summer.

David Ruhnke and Jean Barrett, a New Jersey death penalty defense team representing Michael Jacques in the federal case, filed a court motion late last month asking for an Oct. 5, 2009, deadline for prosecutors to say whether or not the death penalty will be sought.

Federal prosecutors responded with a court motion Friday saying they are still deliberating on the death penalty option and would make a decision before April 2009 — limiting by six months the timeline sought by the defendant.

U.S. Attorney Thomas Anderson wrote in the Nov. 7 court motion that the courts may not interfere with internal Department of Justice deliberations on seeking the death penalty in Jacques' case.

"The government opposes court intervention in its charging deliberations," Anderson wrote. "Such intervention would preclude the executive branch from obtaining information and reaching decisions with … the time-frame it deems appropriate."

Third Man Arrested

Ray Gagnon's landlord, 58-year-old Kevin Grosenheider, has been arrested by Federal agents in connection with the Brooke Bennett murder. Grosenheider was arrested for destroying a laptop computer that his former tenant owned with pornographic materials on it.

A criminal complaint affidavit said Gagnon, an engineer who had known Grosenheider for years, rented a room at Grosenheider's home on Timber Pond Road. Gagnon apparently had called him June 30 when he ran into trouble in Vermont, and asked Grosenheider to throw away a safe that contained evidence that implicated Gagnon and someone else in the sexual assault of a minor girl, the affidavit said.
 
The affidavit said Grosenheider, who was previously interviewed, had initially lied to agents about the call but then later admitted Gagnon had called him. The affidavit also said Grosenheider admitted that in May or June, Gagnon had showed him and a co-worker images of child pornography that Gagnon had received on his cell phone. The affidavit said the images were of a girl in Vermont whom Gagnon claimed to have had sex with. Grosenheider also told agents he later saw the images on Gagnon's computer at the home on Timber Pond Road, and that Gagnon detailed the sexual assault of the girl to Grosenheider.

Micheal Jacques a no-show at his own arraignment

Brooke Bennett's accused murderer pleads "not Guilty"

Michael Jacques, who is charged with the kidnapping, sexual assault and murder of his own niece, Brooke Bennett, was a no-show at his own arraignment on Wednesday. His lawyers entered a "not guilty" plea in his behalf.

U.S. Attorney Tom Anderson has yet to decide whether to ask the attorney general to authorize him to seek the death penalty in the case but has raised the possibility of doing so on several occasions.

Should Anderson pursue the death penalty, his recommendation will need approval from the attorney general. Because the death penalty review process will extend into 2009, the next president’s attorney general will be the one to make the final decision.

Brooke's stepmother said she is of two minds about the death penalty-- she said she really wants to see Jacques suffer and thinks the death penalty may not be punishment severe enough.

Michael Jacques Indicted

A federal grand jury has handed down a 6 count indictment in the case against Michael S. Jacques for the murder and kidnapping of 12-year-old Brooke Bennett, last week.

The indictment states that Jacques intimidated and deceived a 9-year-old girl (referred to as J1 in the document) into believing that she had to engage in sexual acts with him or a powerful organization named "Breckenridge" would kill her. This intimidation lasted from 2003 until 2008.

During those 5 years of sexual abuse, J1 had communications with several fictitious characters belonging to Breckenridge. These communications were through email and text messages.

Around May of 2008, Jacques sent messages to J1, purportedly from Breckenridge operatives, stating that she was expected to assist Jacques in kidnapping Brooke Bennett and turning her over to Breckenridge operatives.

On June 24, 2008, Jacques lured Brooke Bennett to his residence, with the assistance of J1, by leading Brooke to believe that she would be a guest at a pool party on June 25, 2008.

On the 25th, Jacques drove Brooke to a convenience store and left her there under the pretense that he was leaving. He picked up Brooke shortly after and took her to his house. It was then that Jacques allegedly drugged, sexually assaulted, and murdered Brooke.

Count 2 states that around Christmas of 2003, Jacques persuaded, induced and coerced a person under the age of 18 to engage in sexually explicit conduct and made videotapes which were mailed , shipped, or transported across state lines or in foreign commerce.

Count 3 and 4 has to do with two underage persons, in 2005, going through a similar experience as the victim in 2003. These visual depictions were also transported.

The 5th count deals with a young person going through similar acts, again, during the years 2004-2008.

The indictment document has a page entitled "Notice of Special Findings", in which they call the crime particularly heinous. Michael Jacques is eligible for the death penalty, under these crimes, but it is not expected to be decided upon for several months.

An arraignment in federal court has not yet been scheduled.

Also, prosecutors said federal authorities have dropped an obstruction of justice charge against Raymond Gagnon, Brooke Bennett's former step father, which was related to Brooke's disappearance.

A federal grand jury in Texas has indicted Gagnon on charges of production and transportation of child pornography.

More Time needed

Brooke Bennett Update

It could be a couple of more months before we hear any news about the Brooke Bennett murder case.

Federal prosecutors said Wednesday police and the FBI need two more months to finish their investigation into the roles of a former stepfather and uncle in the slaying of 12-year-old Brooke Bennett of Braintree.

In separate filings at U..S. District Court in Burlington, government lawyers asked a federal magistrate to give them 66 days to decide whether to indict the former stepfather, Raymond Gagnon, and 60 days on whether to indict the uncle, Michael Jacques.

In both requests, Assistant U.S. Attorney Craig Nolan said the complexity and quantity of evidence being reviewed requires the extra time.

Pornography Search

Last week Federal authorities in Texas searched a landfill where they believe contains possible evidence in the disappearance and death of Brooke Bennett.

Ray Gagnon had told his landlord to dump a safe containing child pornography and a computer.

"We are working to locate a hard drive or laptop computer that was disposed of at the instruction of Mr. Gagnon," Erik Vasys, a spokesman for the FBI's regional office in San Antonio, Texas said early Friday afternoon. "Based on information we have received, this landfill is the dumping site for trash from his apartment."

Gagnon admitted to police that he accessed Bennett's MySpace page using a laptop taken from the safe in Texas. According to another affidavit in the case, Gagnon asked his landlord there to dispose of his computer as part of a ruse with Jacques to make it look like the girl ran away with a boyfriend.

A former co-worker of Gagnon's tipped authorities off to the fact that Gagnon owned a home in Cullman, Alabama.

Authorities did a public records search and found that Gagnon did own the home along with a woman, according to the affidavit, and that he obtained an Alabama driver's license in 2006.

Federal authorities seized computers and a disk from Gagnon's Alabama home that contained child pornography, according to the affidavit. Gagnon admitted the computers were his, and the images were found in a file linked to the username "Ray," investigators said.

He also admitted to having sexually explicit contact with a minor in South Royalton in 2007 and to owning "vast" amounts of child pornography, according to the affidavit.

Vasys didn't say how long they'll be searching the landfill, and said, "We're treating it like a crime scene. We're excavating part of the landfill."

Autopsy reveals homicide

Brooke Bennett Murder

It's no shock to the community at large that Brooke Bennett's death was a homicide, but the official ruling from Vermont's chief medical examiner has now confirmed it, so that particular procedure has been taken care of. He still hasn't said how she was murdered, though.

State sexual assault charges against her uncle, Michael Jacques, were dropped Monday so federal prosecutors could pursue their case that he kidnapped her. Jacques made his first appearance in federal court.

Also in court Monday-- Brooke's former stepfather, Ray Gagnon, 40, of San Antonio, Texas. His lawyer left court without comment, but told the judge she did not contest the government's motion to keep him in custody.

The judge ordered he, too, was a flight risk and could obstruct the investigation.

Both Jacques and Gagnon will be back in federal court on July 17 for probable cause hearings. We may learn more about the government's case at that time.

Is our justice system to blame for her death???

While gleaning through site after site for information pertaining to the Brooke Bennett murder, I started reading articles from the Burlington Free Press, a site link recommended by one of our members. Besides reading the article itself, I became interested in the comments section as well. The following facetious comment caught my eye.

"What's wrong with everyone? Don't you believe in rehabilitation? The guy served his time. Vermont isn't into locking people up. Get with the program. Vermont is doing away with its maximum security prison in St. Albans and turning it into a women’s facility/day care center. There isn't any place left to put really bad guys. The new mantra is "FORGIVE AND FORGET." After all people deserve a 2nd chance and a 3rd, right? And there's no point in supervising them closely on the street either. They might get caught doing something wrong! Heck, then they'd have to go back to jail and nobody wants that. The legislature, led by Dick Sears and the Gov. know best. Close prisons, reduce street supervision and for Pete's sake don't bring anyone back to jail. Corrections staff need to look the other way to balance the budget. The public needs to "FORGIVE AND FORGET."

This lead me to wonder just what was the Governor of Vermont up too. So I went to the governors site and came across this 2004 article "SUBJECT: Governor’s Commission on Overcrowding Issues Report" http://governor.vermont.gov/tools/index.php?topic=GovPressReleases&id=860&v=Article. Attached was a pdf outlining the recommendations of the Governors Commission.

As I read the report it became very clear what the commenter was upset about. The focus was all about saving money and easing the problems of the poor offenders. Section 6 of the report titled "VI. Need to Set Major Targets for Change" begins with "One way to think about prison overcrowding is to set a major target, that if achieved over a reasonable period of time, will result in a visible and significant reduction in inmate population and cost." What about punishment of the guilty? What about justice for the "Victims"? Then I went through the list of people the commission interviewed before they came to their recommendation. Here is the list.

The parent of an offender, a prisoner advocate, an ex-offender, a women's advocate, a community treatment provider and the sister of an offender, an attorney with the Prisoners Rights Office, a 25-year officer veteran and lead of the Corrections bargaining unit, a friend of a woman prisoner, a DOC volunteer, a family that has been involved with the corrections system for 20 years, a probation officer, the mother of a daughter at Windsor, an ex director of the ACLU, the Aunt of a woman inmate, an inmate, an out of state inmate, another inmate and a welfare to work administrator. Not one of the people interviewed by this commission represented a single victim. It's no wonder that the report reads like an Offenders’ bill of rights!

It's time for the Vermont public to wake up to what’s happening in their state and it's time for the rest of us to ask "What's happening in my state?"

More Details in Brooke Bennett Case

Emails show premeditation and cover-up

Brooke's 14-year-old "cousin"  may have  been duped from the beginning about the sex-ring and the perverts she had been brainwashed by since she was 8 or 9 years old.

According to new affidavits, released in the past couple of days, there were 2 separate email accounts. One was from chvy_21@ yahoo.com, also known as "E", and the other was for a Rauel Domingo at Raueldom@ yahoo.com, also know as "C". From these email addresses comes the story of Brooke's kidnapping.

When first asked about his laptop computer, Jacques told investigators that just a few days earlier the hard drive had malfunctioned so the computer didn't have a hard drive. He told them that he took the computer to Best Buy for replacement or repair, on the 24th of June. Later he said the 25th. When Best Buy was contacted about the repair they said they had no records of any repairs for Jacques or his computer.

There was a hard drive on the computer and many telling emails were accessed from it.

One email written on May 8, 2008, showed a relationship among the "cousin", "E" and "C". ("E" is Jacques and "C" is Rauel). This included a sexual relationship.

Rauel is confessing his love to the cousin while he takes a break from hunting zebra and cape buffalo in Africa.

He lets her know how much he misses her and says he's happy that Breckenridge had decided to give her the summer training program. Breckenridge, of course, is the name of the sex-ring that the cousin thinks she's involved with.

Rauel tells her of rumors he heard that her mother was considering divorcing her dad, and that he's worried about that. He pumps up how wonderful the dad is and how awful the mother is for all of the problems.

It appears that there is a long distance on-line romance going on between the two. In the cousin's response, she says she's crying and upset over the news of her parents. Then she confesses her love to him. (Rauel)

As time goes on and emails are exchanged the cousin sounds more and more upset about things that might be happening with her dad. IMO the emails sound like someone is giving her a bunch of BS, and she's falling for it. (More brainwashing).

When the emails came in on the 20th of June they show the plan to abduct Brooke Bennett.

One email, addressed to the cousin, from Rauel, says,"I am glad to see that you are trying to keep dad calmed down. He's anxious I know, but I want to make sure this goes right."

"I am a little concerned that you aren't quite ready for this yet. Please do whatever you need to do in your head to get ready for this. Just remember the reasons why it must be done and remember that it will go PERFECTLY if everyone does what they are suppose to do."

"I want to know if you are willing to help dad with the take-down and the tie up on Wednesday morning when you get back from Cumberland Farms. He can do it himself, for sure, but I think it would just be easier on him if you helped. I'm thinking that you could help hold her down or whatever while he gets her all bound up and ready to go upstairs. If you are really against it, let me know now, but I think you can handle it. The best thing is if the take-down is quick and quiet and the best chance of that is if you help. I suppose I could just have him tase her and knock her down then do it himself, but that is a little more traumatic than I wanted her to experience that early in the morning..... she will have enough of that later."

She responds back that she will help with the tie down.

Also, on the 20th of June, chvy-21@ yahoo.com wrote to the cousin and mentioned that "C" (Rauel) wanted to postpone Monday and move it to Wednesday or Thursday. He said that that way she wouldn't have to worry about her aunt showing up or anything.

He says in the email, " You will be getting texts on your phone that look like they are from Sam." (I think this is the my space friend that Brooke thought she might be meeting up with and going to a party with later).

"They will say basically that he is begging you to move the date of the party from Monday to either Wednesday or Thursday because he can't make it Monday and he is wicked excited to see Brooke and hang with her."

"I want you to forward those message to Brooke so she can see that he is dying to hang with her and so that you can ask her if Wednesday or Thursday works for her and she could just stay over the night before the party... It will give you an opportunity to say... see Brook I told you he is all about you right now, (Juvenile 2, cousins boyfriend) says he talks about you and the party all the time, lately."

In another email he tells the cousin that they have unexpected problems and they all want this over with, but "C" isn't going to risk "either of you, or us, or Breckenridge being in danger. Then he continued to persuade Brooke about the date change.

An email from Rauel on May 28th, also provided further evidence of the plan to abduct and injure Bennett.

He asks the cousin to come up with a plan that would make it so that nobody knows where Brooke is. He wrote, "Dad gets to have at least a few hours with her. You get time with her if you want. Let me know what you come up with. We need to get with this program soon. I would like to have it done by June 7th, if possible. If not we will have to wait until at lease the 16th for obvious reasons that you already know about."

She responded by telling him she didn't how to get the problem solved. She suggested that they could trick her with some hot guy and end up bringing Brooke to him. Then, for some unknown reason, the cousin says she wants Brooke to suffer.

Then she asks Rauel to please keep her dad, her and her family safe.

The investigators found data from Jacques laptop computer showing the planting of evidence to conceal Jacques role an Bennett's abduction.

Jacques directed a detective to a posting on Brooke's My Space page, suggesting that she may have run off with someone she met on-line. The entries to the My Space page were both posted from Jacques computer. One entry on the 24th, and then edited on the 25th.

On June 26, the day after Bennett's disappearance, Jacques notified the Vermont State Police that he had located a sneaker by the side of a road in Brookfield, Vermont. Detectives later located other items in a wooded area near where the sneaker, that Jacques identified as Brooke's, was located. Among those was a white handkerchief containing human blood and semen,  a pair of torn girl's underwear, and a plastic sandwich bag.

On June 28, Forensic Examiners recovered several emails which show that the participants in the kidnapping planned, manufactured, and planted this evidence to conceal their roles in Brooke Bennett's abduction.

Chvy_21 wrote and told the cousin to have sex with her young boyfriend, then clean up with a clean handkerchief and put the handkerchief into a plastic sandwich bag, seal it up, and hide it.

She wrote back and said she would take care of it. (IMO this sounds like a murder was planned, not an initiation into a sex ring, as the cousin was told.)

Information supplied by Yahoo and Com-cast, as well as other information from the investigation suggests that Jacques was using both the identity of Chvy_21 and Rauel Domingo in order to manipulate the cousin for purposes of his sexual exploitation plans and the kidnapping plan, according to the affidavit.

Both email accounts had only been accessed from Jacques' home and work!

In the cousin's interview she said the emails from Chvy_21 and Rauel were emails from "Breckenridge." She admitted she had never met or had sex with Rauel, and that she had sex once with the person using the Chvy_21 identity, but she had been drugged and couldn't identify him.

On July 2nd, an affidavit was offered to demonstrate that Raymond Gagnon, Brooke's step-dad at one time, had obstructed justice by concealing, altering and destroying tangible objects and evidence.

It was further shown that Gagnon had logged in to Brooke's My Space account and changed the user name and password to the account, using the name and password given to him by Jacques.

Gagnon called the landlord, of a room he was renting, and had him throw a safe out that was full of child pornography. Most of it was from Russia, with children as young as 5-years-old.

He admitted that he had pictures of the cousin having sex with her minor boyfriend, that he received from Jacques by email.
 
He then admitted that both he and Jacques engaged in sex with the cousin at the same time.
 
There are just too many questions that need to be asked... of course the biggest one is "WHY???"
 
Why did Cassandra Gagnon AND her sister (married to Jacques) marry known sexual predators???
 
Who was watching out for the "cousin" from the time she was 9 and beyond???
 
Who are the "cousin's" parents??? Is Jacques her dad??? Step-dad??? Who does she belong to???
 
Why wasn't Vermont keeping an eye on these sexual predators???
 
From what I've learned Jacques was on probation for a sexual assault and kidnapping conviction back in 1993. He was to serve ONLY 6 years, and Vermont let him out after 4 for good behavior.

He's been having sex with a minor for 7 years!!! And who knows what else he's been up to!
 
What's up with that Vermont???
 
Again, I have to ask... is it our "justice system" that's helping these sexual predators rape and kill???
